Customer Hire Terms & Conditions

By paying for any part of your bell tent package Customers are confirming that they have read and accepted our Terms & Conditions as detailed on these pages.

Definitions

Booking Details

are the details given to TTS by the Customer at point of booking specifying the Equipment to be provided on the Event Date;

 Company

means Firefly Camping Ltd. whose registered company number is 08399043;

 Customer

is the person hiring the Equipment from the Company;

 Equipment

is the tent(s) and other equipment specified in the Booking Details and nothing else;

 Event Date

shall be for the period as set out by the Event Organisers and as detailed in the Booking Details;

 Event Organisers

are the production team responsible for the delivery of the overall event;

 TTS (The Ticket Sellers)

are the third-party ticket agent, selling the packages on behalf of the Company according to the Booking Details;

 Hire Charge

is the amount payable by the Customer to TTS for the hire of the equipment as specified in the Booking Details; and

 Period of Hire

is the period of time that the Customer uses the Equipment for as detailed at time of booking.

 Damage Deposit

is the deposit payable by the Customer to TTS at time of booking, and refunded back to the Customer after the event once the Equipment is returned free of damage and / or excessive soiling.

1. Conditions

Unless stated in writing, all orders are accepted subject to the Terms and Conditions of hiring stated below and the Customer, by making or authorising payment, is deemed to have acknowledged this.

 2. The Company Undertakes:

a) To deliver the Equipment and proceed to erect it before the Event Date.

b) Equipment will be delivered according to details given by the Event Organisers in the lead up to the event, as well as Booking Details provided by the Customer at time of booking.

 3. The Customer Undertakes:

a) To pay the balance of their Hire Charge at least 14 days prior to the Event Date. The Company reserves the right not to provide the Equipment should payment not be received by this date.

b) Not to use any lighting, heating, cooking or other gas or electrical appliances of any kind within the tents.

c) Not to light, or allow to be lit, any fire, candle or other naked flame within or close to the Equipment without the prior written consent of the Company.

d) Not to tamper with the structure or any part of the Equipment and in particular not to affix or suspend from the Equipment any item whatsoever without the Company’s prior written consent.

e) To evacuate the tent upon the advice of the Company should the Equipment be deemed unsafe due to high winds or other circumstances outside of the Event Organiser’s control.

 4. Variations

a) The Hire Charge is based on the assumption that the Event Organisers provides a firm and level site of turf (or some other material not impervious to stakes and able to absorb rainwater) and is served by a firm access road adjacent to the site with adequate hard-standing for commercial vehicles, is free from flooding, trees and overhead obstruction. If this is not the case or if the Customer wishes the Company to erect the Equipment in a different position on the site to the one indicated to the Company at the time of booking and in either event the costs to the Company are subsequently increased by reason of increase in labour costs or any other factor the Company may increase the price in accordance with the Company’s published price list and hourly labour rates then in force.

b) The Company will use all reasonable endeavours to supply the Customer with the Equipment but where this is not possible the Company will notify the Customer as soon as possible with any alterations to the design and specifications of the Equipment and where alteration is fundamental the Customer may terminate this contract and any deposit paid will be refunded.

c) If the Customer amends their booking after initial booking has been made, the Company reserves the right to recalculate the Hire Charge and apply a revised amount to the balance due, to cover the cost of delivering any additional Equipment.

 5. Loss Or Damage Or Excessive Soiling

a) The Customer shall throughout the Period of Hire be responsible for the maintenance and safe custody of the Equipment.

b) The Customer must be satisfied with the Equipment before use and should notify the Company of any miscounts, incorrect deliveries or unacceptable Equipment before use.

c) The Customer shall be responsible for, and shall reimburse the Company for, any loss of or damage to all hired equipment whatsoever the cause unless the damage or loss is the fault of the company.

d) The Company shall retrieve any costs incurred as a result of damage, loss or excessive soiling by keeping some or all of the Damage Deposit, dependent upon costs incurred.

e) Upon payment of the ‘Damage Waiver Fee’ referred to at time of booking then the above clause 5c will not apply if the damage to Firefly Camping hire Equipment is accidental. Please note that the Customer will remain responsible for and will reimburse the Company for any loss of or damage to all hired Equipment resulting from their negligence or a criminal act.

 6. Cancellation

a) Either party shall have the right to terminate this Contract without penalty within fourteen days from the date of booking subject to written confirmation of such termination being given by one party to the other within such period. In the event of such termination by either party the Company shall refund to the Customer all sums paid by the Customer to the Company by way of deposit or otherwise.

b) After fourteen days, any Payments made by the Guests or Event Organiser to secure the hire of the Equipment are non-refundable (unless the Guest has paid for extra protection via The Ticketsellers). However, if the Company is able to re-let all of its hire equipment for the booked event date then the Company will return the deposit paid, minus an administration fee of £50 per unit.

c) If the Customer cancels the booking within 28 days prior to the Event Date, the compensation to the Company will be the full Hire Charge including any booking fees (unless the Guest has paid for extra Booking Protections via The Ticketsellers). This includes last minute cancellation as a result of Covid-19.

 7. Company Non-Performance

a) The Company will make every effort to complete the erection of the Equipment before the Event Date, or an alternative date agreed in writing by both parties, provided that the Customer has complied with the undertakings set out above. If the Equipment is not delivered before the Event Date, or the alternative date agreed in writing by both parties, the Customer shall have the right to withdraw and the Company shall return all monies paid.

 8. Liability

a) The Company will not be responsible for any indirect, special or consequential damage or loss suffered by the Customer.

b) The Company’s maximum liability for breach of these terms shall be the Hire Charge.

c) Nothing in these terms shall limit the liability of the Company for fraudulent misrepresentation or death or personal injury arising from negligence.

 9. Third Party Liability

a) The Company will not be responsible for and the Customer will indemnify the Company against all claims relating to injury to persons or loss, damage to property, howsoever caused, except to the extent that liability was caused by faulty material or workmanship or negligence on the part of the Company.

10. Events Preventing Company Performance

a) If the Equipment is not erected by the Event Date due to circumstances beyond the Company’s reasonable control, the Company shall not be liable to perform its obligations under these terms and shall return 50% of the Hire Charge to the Customer only. If only 50% of the Hire Charge has been paid by the Customer, there will be no refund. The retained portion of the Hire Charge shall be used to pay costs incurred by the Company in advance of the Event Date.
